Every person who will operate the rental boat must review and complete this agreement before taking control of the boat.

Important Notice and Assumption of Risk

Serving as captain and operating a boat involves inherent risks that may cause injury, death, or property damage. Captain voluntarily assumes all risks associated with operating, docking, launching, loading, water sports, swimming, weather, waves, currents, submerged objects, equipment failure, and passenger behavior.

Authority and Qualifications

Captain confirms that they are legally permitted, sober, competent, and adequately familiar with operating the boat. Captain will follow all boating laws, capacity limits, and Owner instructions.

Release of Liability

To the fullest extent allowed by California law, Captain releases Owner from claims arising from ordinary negligence related to Captain's operation or control of the boat, water sports, swimming, natural conditions, or other boaters. This release does not apply to Owner's gross negligence or intentional misconduct.

Indemnification

Captain agrees to indemnify and defend Owner from claims, damages, losses, and attorney fees arising from Captain's operation or control of the boat, passenger injuries, water sports activities, violations of law, or damage to persons or property.

Passengers and Minors

Captain is responsible for passenger conduct and safety. All passengers must complete the required waiver, and minors require parent or legal guardian consent. Minors are not authorized to operate the boat.

Safety Equipment and Operation Rules

Captain will ensure required life jackets are worn, maintain a proper lookout, operate sober, follow all boating laws, use provided safety equipment, and never exceed passenger or weight limits.

Water Sports and Swimming

Captain is responsible for safe wakeboarding, tubing, skiing, kneeboarding, wakesurfing, and swimming activities. Captain will keep riders away from the stern and propeller and shut off the engine when retrieving riders or ropes.

Damage Responsibility

Captain accepts responsibility for damage caused by Captain's operation, misuse, negligence, or failure to follow instructions, including propeller, lower-unit, hull, shallow-water, rope-entanglement, ballast, docking, trailer, electronics, bimini, anchor, ladder, and cleat damage.

Launching, Loading, and Docking

Captain assumes responsibility for safely launching, retrieving, centering, securing, docking, and undocking the boat whenever Captain performs or directs those activities.

Inspection and Photo Documentation

Captain will inspect the boat before operation, report undocumented damage before departure, cooperate with pre- and post-use inspections, and promptly report incidents or damage.

Fueling and Mechanical Warnings

Captain will use the correct fuel, avoid shallow water, stop operation if alarms sound or overheating occurs, not run the engine tilted up, and follow all mechanical and operating warnings.

Weather, Wildlife, and Natural Conditions

Captain is responsible for monitoring conditions and must cease operation during unsafe weather or water conditions. Owner is not responsible for weather changes, floating debris, wildlife, or natural hazards.

Alcohol and Passenger Conduct

Captain will not operate under the influence, will prevent unsafe passenger behavior, and will prohibit riding on the bow, gunwales, or swim platform while underway.

No Insurance Provided

Owner provides no insurance for Captain, passengers, or third parties. Captain understands they may be financially responsible for injuries, deaths, or property damage caused by Captain's acts or omissions.

Disputes, Severability, and Governing Law

California law governs this agreement. To the extent enforceable, disputes will be resolved by binding arbitration in Sacramento County, the prevailing party may recover attorney fees, and invalid provisions will not affect the remainder.
